what happens if a guardsmen is about to be executed by a commisar and ends up killing the commisar? what happens then?

weird...it seems as though there aren't very many good solutions to that situation, i mean obviously he'd have to be pretty skilled to kill a commisar, seems like a waste of a good killer to make him into a servitor. what happens at penal legions? (the word peni tells me it's nothing good.)

Penal legions are a entire regiment of criminals from serveral worlds, they are the first into battle.
Servitors have many uses, not just fixing things - look them up in the lexicanum, its a good reference tool.

I imagine that the offending individual and his unit would disband in order to escape the wrath of the Imperium. In an old Imperial Guard Codex (3rd Ed. I believe), a Commissar could execute a guardsman to keep his unit in the fight, but occasionally the unit would turn on the Commissar and then disband.
With the Imperium's complete focus on rooting out "Chaos," I imagine that all members of the unit would be declared heretics, to be hunted down and given the Emperor's Justice.

Exactly why I don't like commissars, when I get an IG army there arent going to be any Commis in it

Man, Commissar's are awesome now. Especially if you blob your units together. A 50-man guardsman blob with a Commissar is nigh unbreakable.
Heck, I even use them in my 20-man units. It keeps them from fleeing the field, plus they get a boost to their leadership.
Also, they let you plant more power weapons/power fists in your guard units. Makes the unit that much more deadly in combat.
